Personal Data Gogoro may Collect, Process and Use

When you sign up for membership or contact us through any channels, in order to confirm your identity and membership, send confirmation letters and other administrative messages, inform you of updates on this Notice or other terms of use, understand your inquiries and needs, and manage all our users, we will collect your basic information, including without limitation your name, date of birth, phone number, mailing address, and email address. Moreover, you would be required to upload a photocopy of your identification and driver’s license (both front and back sides).

When you use the Service, in order to provide you with complete functions and features of the Service, to improve the Service, and to optimize user experience, we will collect information about how you use the Service, including without limitation information about your devices, system setting preference, real-time location, rental term, ride routes, payment details, usage time of Gogoro Network® battery and mileage, traffic tickets during rental terms and details of fine payments, photos you take when returning the rented electric scooter by using GoShare APP as well as your feedback.

When you use the GoShare Service and use GoShare for Business to enjoy the riding discounts/subsidies provided by the Appointed Enterprise (as defined in the Terms of Use), you understand and agree that Gogoro may, for the purpose of performing the contract(s) between Gogoro and the Appointed Enterprise to which you belong and identifying whether to offset your personal riding expense by using the riding discounts/subsidies provided by Appointed Enterprise, Gogoro may receive your personal data (including but not limited to name of your company, job title, current employment status, email address, employment history, etc.) and collect, use, and process the said personal data, and Gogoro may transmit your GoShare account ID, riding time, riding fee, amount of riding discount/subsidies, refund amount, payment status to Appointed Enterprise for their collect, use and process.

If you agree that research institutions or corporate commissioned by government agencies or private entities to conduct data analysis-related projects may indirectly collect your personal data from Gogoro for specific purposes related to investigation, statistics, and research analysis, such as the type of GoShare electric scooter ride, start and end points, and actual riding mileage while riding the GoShare electric scooter. You understand and agree that Gogoro may provide your relevant personal data to the aforementioned third-party research institutions or corporate entities. We will ensure that these research institutions or corporate entities sign a personal data protection and confidentiality agreement, requiring them to obtain your consent before collecting your personal data and to comply with relevant personal data protection laws and regulations.

You agree that in order to promote our business, we may use your basic information and records of use for the purposes of marketing and market analysis, and send you our marketing/promotional communications. If you no longer wish to receive our marketing/promotional communications, you may contact us by sending an email to support.tw@ridegoshare.com and we will immediately discontinue sending you such information.

We may disclose your personal data to the court, investigation authority, law enforcement authority or other administrative authority where we are required to do so by the applicable law, regulation, decision or ruling. To the extent permitted by the applicable laws, in order to prevent harm to your life, body, freedom or property, or for the purpose of statistics-gathering or academic research by government agencies or academic research institutions in the interest of general public, Gogoro may use your personal data accordingly.

In the event that you violate any of GoShare Terms of Use or you use the Service improperly, which leads to any death or damage to bodies or property of GoShare or any third party, or that you violate any traffic regulations during the rental term, Gogoro may initiate a legal action, file a claim, or report to the supervisory authority, and under such circumstance Gogoro may, to the extent permitted by the applicable laws, use your personal data as well.

We may entrust a third-party service provider (“Outsourced Contractor”) to provide any part of the Service. In such circumstances, we will ensure that Outsourced Contractors abide by this Notice and applicable data protection laws/regulations, so as to keep our promise to protect your privacy.

During the term of business operation and/or statutory retention periods, we will collect, process, and use your personal data electronically or manually within the jurisdictions in which we and/or Outsourced Contractors and/or the aforementioned third-party research institutions or corporate entities conduct businesses. It is at your discretion whether to provide your personal data to us. However, if you choose not to provide your personal data or provide incomplete personal data, we will not be able to offer you any or all of the Service.

Your Rights and How to Exercise Them

You may contact us by sending an email to support.tw@ridegoshare.com to exercise the following rights: (i) access your personal data to check and review them; (ii) obtain a copy of your personal data; (iii) supplement or correct your personal data; (iv) request that we cease the collection, processing, or use of your personal data; and (v) request that we delete your personal data. We may accept or deny your request in accordance with the laws or contracts between us.

If you wish to delete or have us cease the collection, processing, or use of your personal data, we will no longer be able to provide the Service. You can contact us via email (support.tw@ridegoshare.com), phone or App to inform us of your request, we will reply via email and send you a “Personal data delete request form.” Please fill out the form and mail the carbon copy to GoShare, Building C, 11F No. 225, Sec. 2, Chang’an E. Rd., Songshan Dist., Taipei City 105404, Taiwan (R.O.C.). Once received, we will notify you via email and disable the account. After we confirm there are no outstanding balances, such as overdue payments or traffic violation tickets, we will proceed with your request according to personal data protection regulations.

Protection of Personal Data

We are committed to implementing and maintaining appropriate safety measures to protect your personal data from being stolen, altered, damaged, destroyed, lost or disclosed. Furthermore, we require that all our personnel comply with relevant policies and security guidelines so as to keep our promise to protect your privacy. However, you acknowledge and agree that no system or technology can guarantee absolute safety of personal data. If you find any inadequacy in the system of GoShare, please contact us by sending an email to support.tw@ridegoshare.com.

Changes to GoShare Data Notice

We reserve the right, but are not obligated, to add, change, edit, modify, amend or delete any part of this Notice without issuing a prior notice. Any changes will be effective as of the date of publication unless otherwise expressed in this Notice. You should periodically check this Notice for any changes thereof. Your continued use of the Services after the modification of this Notice will mean that you agree to be legally bound by the modified terms.
